1. This promotion is being conducted by JK Ansell Limited("JKAL") from 1st Nov 2013 to 31st January 2014 ("Promotion Period").
2. This promotion is valid only for the residents of India above the age of 21 years ("Participants") and is not valid for employees, distributors, franchisees, agents and suppliers of JKAL & any other organization associated with the fan pages or their respective families.
3. Interested Participants can give a missed call to 7303313636 to be eligible for one free sample of KamaSutra SKYN condom (Promotion). Missed calls made from public call outlets or other numbers where the caller is not traceable will not be eligible for the promotion.
4. The first 3000 callers will be contacted on the numbers from which the missed call was received and the Participant is required to share certain data requested such as the name date of birth, gender, mailing address, email id etc. Upon confirmation, one KamaSutra SKYN condom sample (Sample) would be sent to the Participants address as provided by him / her. Such Participant would also be eligible for participating in a further contest run by JKA and will accordingly be intimated about the modalities of participating in the contest.
5. The first 3000 callers are invited to share their SKYN experiences (80 characters maximum) after using the KamaSutra SKYN condom. Out of the valid entries received during the Contest Period from the Participants, JKA jury will select 11 entries (Winners).
6. The sender of the best entry will be entitled to an IPad and other _10___ entries will be entitled to KamaSutra gift hampers_(hereinafter referred to as the Prize).

The Participant and or the Winner grants JKAL irrevocable consent in perpetuity to the use his/ her name, entries and such other details taken during the Promotion Period in any and all applications including but not limited to advertising, commercials, promotion, stories, text, articles and commercial exploitation, in any and all media forms, including but not limited to radio, broadcast and television, newspapers and magazines at any time without the Participant and or the Winners further knowledge or consent.
13. The contact details provided by the Participant will be maintained by JKAL and will be used by JKAL for communicating the promotional messages and such other purposes, which the Participant authorizes JKAL by filing up this form.
14. The Participant and or the Winner acknowledges that he/ she will not hold JKAL and/ or any of its affiliates or agencies engaged by them with regard to this Contest liable for any loss or opportunity, monetary loss due to their participation in the Contest, and or use of the Sample and/ or Prize.
15. Mere participation should not be perceived as any commitment on the part of the JKAL to select a participant as the Winner. Nothing herein amounts to a commitment by JKAL to conduct further, similar or other offers in future.
16. Under no circumstance, shall JKAL and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the Participant and/or the Winner and or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if JKAL has been advised of the possibility of such damages. 17. Winners shall follow instructions as provided by JKAL and or the organizers and any such third party associated with the Contest and or Event. Participants and or Winners must comply with all applicable rules and regulations under this Promotion, Contest and or Event.
18. The holding of the promotion / Contest is subject to force majeure conditions.
19. JKAL reserves its right to change, discontinue, and extend the Promotion or Contest and/or modify the terms and conditions thereof without giving any prior notice to the Participants/ Winners.
20. JKAL will not be liable to resend or replace the samples or Prizes if damaged or lost during transit.
21. In the event of dispute with the terms and conditions, JKAL decision shall be final and binding on the Participants / Winners. These terms and conditions shall be governed by the laws in India and disputes if any with respect to the Contest/ Sample/Event will be subject to the exclusive jurisdiction of the courts in Mumbai.
TERMS AND CONDITIONS for KS DEO SMS Contest
1. This promotion is being conducted by JK Ansell Limited (“JKAL”) from 23rd Feb 2014 to 5th April 2014 (“Promotion/Contest Period”).
2. This Promotion/Contest is valid only for the residents of India above the age of 21 years (“Participants”) and is not valid for employees, distributors, franchisees, agents and suppliers of JKAL & any other organization associated with the fan pages or their respective families.
3. Participants have to complete the line/slogan “The ___ ___ Image Booster – Men Can’t Miss and Women Can’t Resist” with two words in the two blanks. Participants have to send their entries by way of SMS as “KSDEO < two words answer > (prescribed format) to 575758 during the contest period. The words filled in the blanks should be sensible, meaningful and should complete the line/slogan.
4. Participants shall bear the SMS charges, charged by participant’s service provider.
5. JKAL shall select the one best “line/slogan” entry/SMS at its own discretion (“Winner”). Winner will be entitled to (a) two return air tickets from Mumbai to Bangkok (economy class) and (b) three nights and four days accommodation in Bangkok for two persons (“Prize”).
6. JKAL’s decision in connection with the selection of winning entry will be final and binding. JKAL shall not entertain any questions, correspondence, enquiries on the manner of conduct of the Contest, selection process and grant of the Prize from any party whatsoever. Entries received after the contest period shall not be considered.
7. JKAL shall communicate its decision to the Winner regarding his/her win on the mobile number from which the Winner had sent his/her entry. Winner shall respond to JKAL from same mobile number indicating his/her acceptance of such Prize within the 05 (five ) working days. Winner shall provide other details as required in the intimation in the intimation from JKAL such as name, age, gender, email ID, postal address, and city etc. along with his acceptance of Prize. The Winner shall ensure that the mobile number is kept valid and is in continuous service. JKAL shall not be liable for non receipt of intimation by Winner and shall be free to give away the Prize to the next best entry after 5 days from the date of such intimation. JKAL shall not be liable to verify safe delivery of the intimation SMS.
8. JKAL may email or dispatch flight tickets to winner at the email id / postal address provided by the Winner and JKAL shall not be liable to winner for any delay in providing the flights ticket to Winner due to delay/suspension of logistic services. Thereafter, all the communications to the Winner will be made on email ID and/or on the mobile number from which Winner has sent his/her entry.
9. On receipt of such intimation from the JKAL, Winner shall produce all its documents for proof of age/ identity/address such Voters ID, Passport and any other relevant documents as may be required by JKAL. In case JKAL does not receive the relevant documents within the prescribed time the Winners opportunity to win the Prize shall stand forfeited and an alternative winner may be chosen by the JKAL as per its sole discretion.
10. JKAL reserves the right to decide on the flights date, time, airline (direct or stopover flights) etc. Winner shall be liable to comply with all terms and condition of airlines. JKAL shall not be liable for cancellation of fights, missing of flights or connecting flights etc., Winner shall liable to bear all expenses for reaching Mumbai airport from his/her place of residence. Winner shall also bear expenses towards Visa charges, extra baggage charges, other facilities, taxes and any other charges/taxes in connection therewith.
11. JKAL at its own discretion shall decide the hotel accommodation type, area etc. and Winner shall comply with all terms and conditions prescribed by such hotel. Winner shall adhere to check out timings of the hotel. JKAL shall not be liable for any additional charges except room charges. Any additional charges in connection with room facilities, food, beverages, laundry, telephone, internet etc., shall be borne by Winner itself. In additions to above, Winner shall also bear the expenses for travelling from Bangkok airport to hotel and internal travelling during his/her stay in Bangkok.
12. The Winning Prize is non-transferable and non-refundable and cannot be exchanged or redeemed for cash. No cash claim whatsoever can be made in lieu of the Prize.
13. The service provider for the flight and place for accommodation will be decided by JKAL. JKAL shall not be liable for any dispute raised regarding quality of the flight /accommodation services provided by the service provider.
14. JKAL would not be liable or held responsible for any technical error, lack or lapse or non receipt of any communication on account of failure or delay by Internet, Telecom and / or E-mail service provider. No correspondence in this regard will be entertained.
15. JKAL is not responsible for any errors or omissions in the terms and conditions contained herein. All information provided in the Contest is provided "As is" without warranty of any kind. The Participant and or the Winner releases and agrees to hold harmless JKAL from any and all liability for any injuries, loss or damage caused during the participation in the contest, or prize thereof, and specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against JKAL and/or their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Contest and/ or the Prize.
21. Save as above, JKAL shall not be liable for any act of Winner. Any disputes arising due the conduct of Winner, shall be entertained directly against the Winner. Winner undertakes to indemnify JKAL for all disputes, claims, expenses, losses and damages caused to JKAL on account of any disputes/ claims raised by the Airlines and hotel accommodation service provider against the Winner.
22. Winners shall follow instructions as provided by JKAL and or the organizers and any such third party associated with the Contest and or Event. Participants and or Winners must comply with all applicable rules and regulations under this Promotion, Contest and or Event.
23. The holding of the promotion / Contest is subject to force majeure conditions.
24. JKAL reserves its right to change, discontinue, and extend the Promotion or Contest and/or modify the terms and conditions thereof without giving any prior notice to the Participants/ Winners.
25. In the event of dispute with the terms and conditions, JKAL decision shall be final and binding on the Participants / Winners. These terms and conditions shall be governed by the laws in India and disputes if any with respect to the Contest/ Event will be subject to the exclusive jurisdiction of the courts in Mumbai.
